Chief Justice Gertrude Esaaba Torkonoo is poised to reassign the confirmation application filed by the Office of the Special Prosecutor against Cecilia Dapaah to a new judge.
This is required since the Judge presiding over the case, Edward Twum, is about to start his vacation.
The Chief Justice granted the High Court Judge a warrant to sit during the legal holiday, and he is now due for his yearly leave.
The OSP had previously requested that the Chief Justice withdraw the judge from all of its cases, including those involving Cecilia Dapaah, due to apparent bias against the office and the special prosecutor’s person.
The petition caused the main application to be adjourned while the parties awaited a response from the Chief Justice.
On October 25, however, the Chief Justice refused the motion to remove the Judge from the case.
This prepared the way for a possible hearing and decision on the application to affirm the order to confiscate the cash discovered in the former sanitation minister’s residence, as well as the order to freeze various bank accounts associated with her.
However, when the matter was called on Wednesday, November 8, Judge Edward Twum invited the parties to his chambers. Cecilia Dapaah, her husband, and their attorneys, as well as lawyers from the special prosecutor’s office, were in court.
Following that, sources close to the parties told the media that due to the absence of Justice Edward Twum, the case may be presided over by a different judge at the next postponed date. The case has been rescheduled until November 29.
